2. Nominative Fair Use Trademark Disclaimer
GTmetrix is a registered trademark of Carbon60 and group.one. GT Vitals (gtmetrix.in) is an independent website performance diagnostic, Core Web Vitals telemetry, and frontend optimization engineering service. GT Vitals is not affiliated with, authorized, sponsored, or endorsed by GTmetrix, Carbon60, group.one, or any of their affiliates or subsidiaries. Any reference to "GTmetrix" or third-party trademarks is strictly for nominative, comparative, and informational identification purposes under established nominative fair use principles.
3. Diagnostic Tooling & Fair Usage Policy
The Platform offers complimentary automated web performance audits powered by open-source Google Lighthouse and CrUX telemetry APIs. Users agree to use the Platform fairly and responsibly:
- Each individual IP address is allocated up to 5 complimentary live speed audits per 24-hour cycle.
- Automated scraping, denial-of-service stress tests, or deliberate attempts to overwhelm test nodes are strictly prohibited and will result in permanent IP blacklisting.
- You agree that you either own or possess legitimate authorization to test the web properties submitted to our diagnostic engine.
4. 90+ Score Mobile Speed Sprint Guarantee Terms
For clients engaging our paid performance optimization sprints (Starter WP Boost, Business 90+ Score Guarantee, or Enterprise Custom Sprints), the following contractual provisions apply:
- Scope of Work: Our senior engineers perform non-destructive frontend code refactoring, critical CSS extraction, JavaScript deferral, asset compression (WebP/AVIF), and server-level caching configuration.
- Staging Verification: All structural changes are benchmarked and verified on a staging clone prior to production deployment to ensure zero disruption to e-commerce checkouts, payment gateways, or layout integrity.
- 100% Money-Back Guarantee: If our engineers fail to achieve the mutually agreed mobile Google Lighthouse score threshold (90+) on the agreed canonical landing page within the sprint delivery window, the client is entitled to an immediate 100% full refund upon request.

5. Intellectual Property Rights

6. Limitation of Liability
The complimentary speed diagnostic reports and advice provided on the Platform are offered on an "as-is" basis for diagnostic evaluation. In no event shall GT Vitals or its engineers be liable for indirect, punitive, or consequential damages resulting from the use or inability to use the diagnostic tools or third-party recommendations.
